One of my recent approaches, which espero claudique en un proyecto de investigación, que dada mi carga de trabajo actual, probablemente revistirá la forma de artículo, es el constitucionalismo conservador mexicano.
Los estudios que sean hecho de este perido histórico, se han limitado analizar cuestiones estrictamente legalistas, o si se quiere, de diseño institucional como lo a hecho el profesor Pantoja Moran desde hace ya algún tiempo. Lo que a mí me gustaría hacer en realidad, es un análisis, no acerca de cuales son las similitudes y ruputras de estos constitcuionalismo con la constitución de 1824, sino todo lo contrario; ie a box that allows me to study dilucicidar what the real reasons for the existence of the constitution of 1836 and 1843 bases. It happened to me as a point of originality, the following ideas:
- What is meant by will of the people at the time of the social structure of the time. What role did
- federalism for the establishment of central constitutions.
- political activism, lack of legal sense, factionalism constituent.
- Above all the similarity of the legal concepts fundamental constitutional right, and the survival of Indian law, for example. the deconstitutionalization private law, the constitutionalization of the Indian criminal law principles, the idea of the right surgimineto THROUGH corporations, government theories.
- The connection between the concept of nationalism and conservative constitutionalism, or their ruputura. Freedom of expression and
